Mining Sector Regulatory Framework Rationale




Environmental management is a collective responsibility and require a coordinated approach where all stakeholders play their respective roles effectively. Under this component, ECZ will facilitate the Capacity Building Programmes of delegated authorising agents such as MSD. The capacity building of the identified stakeholders will be implemented through the existing institutional arrangements with modifications where necessary. The Capacity Building Programme activities for the identified stakeholders will include training, technical support, student attachments, and provision of equipment. Key stakeholders will be members of the Environmental Stakeholder Forum (ESF) which was set up under the ESP.

The ESF will hold two meetings in a year, one in Lusaka and the other on the Copperbelt. Among the issues that the ESF will tackle will include resettlement of former miners, public health and other social issues. The identified key stakeholders in implementing the CEP include:

MSD Department of Water Affairs/Water Board Forest Department Local Authorities Ministry of Health (CBOH) UNZA & CBU National Heritage Conservation Commission(NHCC) Ministry of Tourism, Environment & Natural Resources ZAWA Industry Partnerships Civil Society like NGOs and CBOs

This sub-component has three objective with outputs and activities as follows:

Obejective 1: To strengthen training and research and institutional linkages through provision of training and research tools and student attachments
Output 1: Twenty Students from tertiary institutions attached to ECZ per year
Activity 1 Prepare attachment program for students
Activity 2 Select and put students on attachment programsr
Output 2: Research areas and tools identified and relevant research institutions supported
Activity 1 Assessment of needs at collaborating entities (excl MSD
Activity 2 Procure identified tools and materials (Excl. MSD)
Activity 3 Support institutions implementing the identified training and research (excl MSD
Objective 2: To enhance co-ordination and partnership with authorising agencies and collaborating institutions so that they effectively participate in the regulatory framework
Output 1:: Enhance coordination with MSD and other delegated Authorising agencies and collaborating institutions
Activity 1 Clarification of areas of responsibilities between ECZ and MSD with the purpose of signing an MoU
Activity 2 Provision of Logistical support to MSD
Activity 3 Constitute Inter-Agency Regulatory Committee
Activity 4 Hold Inter-Agency Regulatory Committee meetings
Activity 5 Facilitate authorising agencies to follow on recommendations aimed at improving coordination and enforcement capacity, resettlement of former miners, health and other social issues
Activity 6 Develop Guidelines to clarify roles of authorising agencies in the Regulatory Framework
Activity 7 Develop a monitoring and Evaluation plan
Activity 8 Participate in the implementation of some activities identified in the CEMP
Activity 9 Support monitoring activities related to the project
Objective 3: To raise awareness on Cleaner Production in Industry, in order to improve environmental quality and human health
Output 1: Increased number of companies participating in Cleaner Production and those implementing Environmental Management Systems (EMS)
Activity 1 Identify companies to participate in Cleaner Production programmes
Activity 2 Prepare Cleaner Production programs based on ECZ-ZACCI model
Activity 3 Publicise programs and hold training workshops
Activity 4 ECZ requests companies to submit reports on EMS
Output 2: Small Scale Miner’s environmental management capacity enhanced
Activity 1 Provide support for capacity building to small-scale miners
