Mining Sector Regulatory Framework Rationale




The main focus of this sub component is to improve legal framework and to strengthen enforcement capacity of the ECZ and delegated authorising agencies. This is mainly being addressed through harmonisation of EPPCA regulations themselves and as well as with those of delegated authorising agents such as Mining and Minerals Environmental regulations of the MSD. Legislation in Zambia has been drafted to harmonise with the EPPCA such as ZAWA Act, Zambia Forestry Act, ERB Act, and Investment Act. This will also enable ECZ to co-ordinate enforcement of environmental legislation. Under this sub component, the licensing systems and costs will be reviewed. This will be with a goal of putting in place mechanisms that rewards compliance with environmental regulations while non-compliance is charged a cost to the environment. In addition the licensing period will also be reviewed for improvements so as to allow more time for monitoring activities.

This sub-component has two objectives with outputs and activities as follows:

Obejective 1: To strengthen environmental legislation in order to improve monitoring and enforcement
Output 1: Gaps in relevant regulations identified and harmonized
Activity 1 Solicit technical assistance to conduct a review to identify gaps and duplications in all relevant regulations
Activity 2 Workshop with participation of key stakeholders to discuss Consultancy Report
Activity 3 Prepare a report detailing proposed amendments to the regulations
Activity 4 Undertake public consultation to discuss the proposed amendments.
Activity 5 Prepare proposed amendments to the regulations and submit to the government for endorsement
Output 2: Air pollution regulations for mobile sources developed
Activity 1 Prepare an inventory of GHGs to provide information to meet Zambia’s obligations to Climate Change convention
Activity 2 Undertake a baseline ambient air quality study with respect to mobile sources for SO2, Pb, NOx, PM10, VOCs and country background levels
Activity 3 Collection of secondary data on fuel specifications on the market
Activity 4 Collection of data on air pollution related ailments
Activity 5 Collection of information and sample regulations from other countries
Activity 6 Conduct study on levels of lead in soils along selected highways to correlate with the mobile sources
Activity 7 Develop mobile air standards and regulations
Output 3: Noise pollution regulations developed
Activity 1 Undertake a baseline study on noise sources and levels
Activity 2 Develop ambient noise standards
Activity 3 Draft noise pollution regulations Public consultative workshop to review proposed standards and regulations
Activity 4 Public consultative workshop to review proposed standards and regulations
Activity 5 Preparation of final draft noise pollution regulations
Objective 2: To review pollution standards so as to incorporate total pollutant loads in pollution permits
Output 1:  EPPCA standards incorporate total pollutant loads in licensing facilities licenses
Activity 1 Conduct study for incorporation of pollution load into the regulations
Activity 2 ECZ reviews the consultants pollution load recommendations
Activity 3 Stakeholders pollution loads review workshop
Activity 4 Drafting of the final pollution loads, incorporation of amendments & submission to Government
